Red face Staffing Agencies?

There seems to be a plethora of H2B staffing companies- I did a google search a found several. What is the deal with these places? How do they work? Do they actaully act as the Petitioner on the ETA 750 and I-129, or do they just have staff attorneys that fill out the paperwork with the actaul employer's information? If they do act as the Petitioners (which it seems on some webpages that they do by the way they word their pitch), how do they prove temporary need? Doesn't the need evidenced have to be the employer's need, not the staffing company's? I am curious about these b/c I just don't get how they operate. I have a client that has had several dozen H2B workers for the past few years, but it is getting harder and harder to get them approved because the need is a peakload need that is recurring in nature and the DOL and USCIS are telling us that continuous temporary need is the same thing as permanant need, and thus does not qualify for H2B (which, of course, makes sense!). But my client vehemently claims that his competitiors in the same industry (shipbuilding) are hiring H2B workers on a constant basis with no problem and he wants to know how that can be when we are having such dificulty. I was thinking maybe they are using these staffing agencies, but I just don't know. Anyone have some insight?
